These Terms of Service ("Terms") govern your access to and use of armbury.com (the "Site"), and your purchase of products from ARMBURY. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
The Site is operated by ARMBURY, headquartered at 4 Long Shoals Rd, Arden, NC 28704, USA. Reference to "ARMBURY," "we," "us," or "our" means ARMBURY and its affiliates.
You must be at least 18 years old and able to form a binding contract to purchase products or open an account. By placing an order, you represent that you meet these requirements.
Product descriptions, specifications, certifications, and pricing on the Site are subject to change without notice. We make reasonable efforts to display products and pricing accurately, but we do not warrant that descriptions or other content are error-free. In the event of a pricing or description error, we reserve the right to cancel orders, refund payments, and correct the error.
Your submission of an order constitutes an offer to purchase, which we may accept or decline. A contract is formed only when we send a shipping confirmation. We reserve the right to limit quantities, refuse service, or cancel orders at our discretion. All payments are due at the time of order unless we have agreed to alternative terms in writing.
Shipping methods, fees, and estimated delivery times are shown at checkout. Title and risk of loss pass to the buyer upon our delivery to the carrier (FOB Origin), unless otherwise agreed in writing. Delivery dates are estimates and are not guaranteed.
ARMBURY products carry the warranty stated on the product page or in the product documentation. Returns are accepted in accordance with our Returns Policy. Products that have been used in a fall, exposed to chemicals, modified, or damaged beyond normal wear are not eligible for return. Contact support@armbury.com for return authorization before shipping any product back.
ARMBURY products are designed for trained professional users. It is the user's responsibility to: read all product documentation; receive appropriate training; inspect equipment before each use; understand the relevant standards (UIAA, EN, ANSI Z359, ANSI Z133, etc.); and use products only within their stated specifications. ARMBURY disclaims all liability for misuse, use beyond rated capacity, use with non-compatible equipment, or use by untrained persons.
All content on the Site — including text, images, logos, designs, product names, technology names (SYNX, DRY PRO, INTERCORE, TBS, READY HANK, DUOCOLOR, THERMO SHEATH, SCANNABLE NFC, MAXIM TENSION), and software — is the property of ARMBURY or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial viewing of the Site.
If you submit reviews, photos, comments, or other content to the Site, you grant ARMBURY a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display that content in connection with the Site and ARMBURY's marketing. You agree not to submit content that is unlawful, defamatory, infringing, harmful, or that misrepresents ARMBURY products or their performance.
EXCEPT AS EXPRESSLY STATED IN WRITING, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARMBURY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARMBURY'S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL ARMBURY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify, defend, and hold harmless ARMBURY and its officers, directors, employees, and agents from any claim arising from your use of the Site, your purchase or use of products, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict of laws rules. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction in those courts.
We may modify these Terms at any time. Material changes will be communicated on the Site. Your continued use of the Site after changes are posted constitutes acceptance.
